Terms of service

1. Scope
The General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all legal transactions concluded via the ImmuFlow GmbH online shop. This online shop is operated by ImmuFlow GmbH, 8966 Oberwil-Lieli (hereinafter referred to as ‘ImmuFlow GmbH’). ImmuFlow GmbH reserves the right to change these GTC at any time. The version of the GTC valid at the time of the order is decisive.

2.      Offer
The products and prices in the online shop are considered an offer. The offer is valid as long as the product is available in the online shop and in stock.

3.      Prices and shipping costs
ImmuFlow GmbH is free to set prices and change them at any time. The price published on the website is decisive when placing an order. If prices have been published in error, ImmuFlow GmbH reserves the right to inform the customer before shipping the respective item in order to agree on a price correction or to cancel the order.

Prices are quoted in Swiss francs as standard.

Delivery is only available within Switzerland and Liechtenstein and is free of charge for orders over CHF 75.-. For orders under CHF 75.-, delivery is subject to a flat-rate shipping charge of CHF 4.90 instead of CHF 8.90 for Switzerland and Liechtenstein.

No further taxes or costs shall be incurred (with the exception of any customs duties and import taxes for deliveries abroad) and subject to any other contractual agreements.

4.      Information provided
ImmuFlow GmbH always endeavours to keep the data published in the online shop up to date and accurate. However, production and/or delivery bottlenecks may cause delays in delivery. Therefore, all information regarding availability and delivery times is subject to change and may change at any time. ImmuFlow GmbH does not guarantee the accuracy or timeliness of information provided by other manufacturers, even if it has been carefully researched.

5.      Conclusion of contract
The purchase contract is concluded when the order is submitted (online) and accepted by ImmuFlow GmbH. A prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided on the Internet and the acceptance of these General Terms and Conditions (GTC).

ImmuFlow GmbH confirms receipt of the order by means of an automatically generated order confirmation by email. This merely indicates to the customer that the order has been received and that the purchase contract has been concluded subject to availability and the correct price being stated.

6. Delivery terms for goods
Physical goods are delivered within Switzerland and Liechtenstein. Deliveries to other countries must be requested.

Delivery to Switzerland and Liechtenstein: Delivery time via Swiss Post (Economy shipping) is usually 2–3 working days, depending on Swiss Post's delivery times, unless otherwise stated in the offer.

If not all of the products ordered are in stock, ImmuFlow GmbH is entitled to make partial deliveries. If the delivery is made in partial shipments, the customer only pays the flat-rate shipping costs once.

If delivery of the goods fails through the fault of the customer despite two delivery attempts, ImmuFlow GmbH may withdraw from the contract. Any payments made will be refunded minus the costs incurred.

If the goods cannot be delivered due to force majeure or product discontinuation, or if ImmuFlow GmbH is unable to procure the ordered products under reasonable conditions, and if these circumstances arise after the conclusion of the contract and are not the responsibility of ImmuFlow GmbH, ImmuFlow GmbH shall be released from its delivery obligation. If events occur that make delivery significantly more difficult or impossible for ImmuFlow GmbH – for example, strikes, lockouts, official orders or similar – ImmuFlow GmbH shall not be responsible for delays, even in the case of bindingly agreed deadlines and dates.

7.      Inspection obligation
The delivered or collected products must be inspected by the customer immediately upon receipt for completeness, correctness and delivery damage. If there is a defect, ImmuFlow GmbH must be notified within 7 calendar days and the product must be in its original condition for return.

8.      Right of revocation and right of withdrawal
A right of revocation from the purchase contract is generally not possible.

Withdrawal from the contract by the customer is only possible in exceptional cases in accordance with the following provisions of these General Terms and Conditions and in addition to the provisions of the Swiss Code of Obligations.

9.      Warranty and default
In the event of loss, damage or incorrect delivery of parcels, Post CH AG, commissioned by the provider, is liable within the scope of its general terms and conditions ‘Postal services for business customers’. The provider is not liable for this.

ImmuFlow GmbH warrants that the goods have the promised characteristics, have no defects that impair their value or suitability for the intended use, and comply with the prescribed performance and specifications. In the case of services, the provider guarantees that it will act with due care.

10. Liability and disclaimer
ImmuFlow GmbH is only liable for the warranty services listed in section 9. Any further liability is excluded – in particular liability for damage that has not occurred to the products themselves. This may include indirect and consequential damages such as lost profits, unrealised savings or damages resulting from delayed delivery. Furthermore, ImmuFlow GmbH is not liable for damages caused by improper storage.

11. Payment
The invoice for the goods must be paid in the currency specified therein immediately upon or after placing the order. The following payment methods are accepted in the online shop: TWINT, credit card, Apple Pay, Google Pay.

12. Data protection
ImmuFlow GmbH only collects personal data that is necessary for the conclusion of the contract. This data will not be processed further without the separate consent of the buyer.
The data will only be passed on to third parties if this is necessary for the processing of the order.

13. Place of jurisdiction and applicable law
Swiss law applies exclusively.
For customers residing in Switzerland, the legal places of jurisdiction according to the Swiss Civil Procedure Code (ZPO) apply.
To the extent permitted by law, the District Court of Bremgarten, Pflanzschulstrasse 7, 5620 Bremgarten AG, Switzerland, is responsible for disputes with companies.
